From the first woman to sit on the United States Supreme Court comes this fascinating book about the history and evolution of the highest court in the land. Out of Order sheds light on the centuries of change and upheaval that transformed the Supreme Court from its uncertain beginnings into the remarkable institution that thrives and endures today. Justice OConnor weaves together stories and lessons from the history of the Court, charting turning points and pivotal moments that have helped define our nations progress, and provides a rare glimpse into the Supreme Courts inner workings: how cases are chosen for hearing; the personal relationships that exist among the Justices; and the customs and traditions, both public and private, that bind one generation of jurists to the next.--From publisher description.

Former Florida governor Jeb Bush and prominent constitutional attorney Clint Bolick explore the current and divisive topic of immigration. The authors explain that over the past several decades, a large percentage of immigrants have entered the U.S. illegally, and argue that the immigration system needs an overhaul. They propose a solution to the immigration problem centered around two core principles: immigrations importance to the U.S.s future; and the need for structure in immigration.

An insiders account of the momentous ideological war between the John Roberts Supreme Court and the Obama administration. From the moment John Roberts, the Chief Justice of the United States, flubbed the Oath of Office at Barack Obamas inauguration, the relationship between the Supreme Court and the White House has been confrontational. Both men are young, brilliant, charismatic, charming, determined to change the course of the nation--and completely at odds on almost every major constitutional issue. One is radical; one essentially conservative. The surprise is that Obama is the conservative--a believer in incremental change, compromise, and pragmatism over ideology. Roberts--and his allies on the Court--seek to overturn decades of precedent: in short, to undo the victory FDR achieved in the New Deal. And now they are linked in history by Robertss stunning vote to uphold Obamacare. As the nation prepares to vote for President in 2012, the future of the Supreme Court is also on the ballot--From publisher description.

The rule of law has vanished in Americas criminal justice system. Prosecutors now decide whom to punish and how severely. Almost no one accused of a crime will ever face a jury. Inconsistent policing, rampant plea bargaining, overcrowded courtrooms, and ever more draconian sentencing have produced a gigantic prison population, with black citizens the primary defendants and victims of crime. In this passionately argued book, the leading criminal law scholar of his generation looks to history for the roots of these problems -- and for their solutions. The Collapse of American Criminal Justice takes us deep into the dramatic history of American crime -- bar fights in nineteenth-century Chicago, New Orleans bordellos, Prohibition, and decades of murderous lynching. Digging into these crimes and the strategies that attempted to control them, Stuntz reveals the costs of abandoning local democratic control. The system has become more centralized, with state legislators and federal judges given increasing power. The liberal Warren Supreme Courts emphasis on procedures, not equity, joined hands with conservative insistence on severe punishment to create a system that is both harsh and ineffective. What would get us out of this Kafkaesque world? More trials with local juries; laws that accurately define what prosecutors seek to punish; and an equal protection guarantee like the one that died in the 1870s, to make prosecution and punishment less discriminatory. Above all, Stuntz eloquently argues, Americans need to remember again that criminal punishment is a necessary but terrible tool, to use effectively, and sparingly. - Publisher.

The untold story of how poison rocked Jazz Age New York City. A pair of forensic scientists began their trailblazing chemical detective work, fighting to end an era when untraceable poisons offered an easy path to the perfect crime. Chief medical examiner Charles Norris and toxicologist Alexander Gettler investigate a family mysteriously stricken bald, factory workers with crumbling bones, a diner serving poisoned pies, and many others. Each case presents a deadly new puzzle and Norris and Gettler create revolutionary experiments to tease out even the wiliest compounds from human tissue. From the vantage of their laboratory it also becomes clear that murderers arent the only toxic threat--modern life has created a kind of poison playground, and danger lurks around every corner.

This book, based on the Tanner Lectures on Human Values that Justice Stephen Breyer delivered at Harvard University in November 2004, defines the term active liberty as a sharing of the nations sovereign authority with its citizens. Regarding the Constitution as a guide for the application of basic American principles to a living and changing society rather than as an arsenal of rigid legal means for binding and restricting it, Justice Breyer argues that the genius of the Constitution rests not in any static meaning it might have had in a world that is dead and gone, but in the adaptability of its great principles to cope with current problems. Giving us examples of this approach in the areas of free speech, federalism, privacy, affirmative action, statutory interpretation, and administrative law, Justice Breyer states that courts should take greater account of the Constitutions democratic nature when they interpret constitutional and statutory texts.--BOOK JACKET.

Austin Sarat and William L.F. Felstiners new book, based on a pioneering and intensive study of actual conferences between divorce lawyers and their clients, provides an unprecedented behind-the-scenes description of the lawyer-client relationship, and calls into question much of the conventional wisdom about what divorce lawyers actually do. Divorce Lawyers and Their Clients suggests that most divorces are marked less by a pattern of aggressive advocacy than by one of inaction and drift. It uncovers reasons why lawyers find divorce practice frustrating and difficult and why clients frequently feel dissatisfied with their lawyers. This new work provides a unique perspective on the dynamics of professionalism. It charts the complex and shifting ways lawyers and clients negotiate their relationship as they work out the strategy and tactics of divorce.--BOOK JACKET.
